This promotional offer (“Offer”) is valid from January 1st, 2023 to December 31st, 2023. ( “Offer Period”) and is limited to Canadian and US merchants meeting each of the following eligibility criteria ( “Eligibility Criteria”):
1. Limited to new Yocale Pay merchants. Yocale Pay does not guarantee a merchant’s approval for merchant services and reserves the right to determine a qualified merchant according to its credit adjudication and other policies. Merchants will be required to agree to the terms and conditions.
2. It does not apply to the merchant if the merchant participates in a merchant program for franchisees, trade associations, member associations or other buying groups.
Details and Limitations of the offer
A merchant that meets the Eligibility Criteria will receive the following, as determined by Yocale Pay in its sole discretion:
1. Yocale Pay will credit the merchant’s account once based on the volume of Interac debit and credit card transactions. In the first 90 days following implementation, merchant agreements are evaluated based on the following criteria:

A merchant has the option to select one (1) of the Yocale Pay terminals:
(i) Poynt Smart Terminal
(ii) Poynt 5
(iii) Newland N910
(iv) Ingenico Desk 5000
(v) Ingenico Move 5000
The merchant has the option to receive the credit in one of the following ways:
(i) The credit will be applied against future fees for Yocale Pay payment services.
(ii) Yocale Pay will mail a prepaid credit card with the eligible rebate credit amount to the merchant.
Yocale Pay is not obligated to offer an alternative if a merchant declines the offer option made by Yocale Pay.
There is a limit of one (1) offer per merchant that meets the eligibility criteria. The merchant entity may be a party to more than one Merchant Agreement at the same time.
Any Offer for Yocale Pay payment processing services is subject to change, withdrawal or cancellation at any time. Merchants who terminate their Merchant Agreement before its expiry will pay Yocale Pay the value (or amount) of the Offer they received. The merchant remains liable for all other fees and payments under their Merchant Agreement, including restocking fees.
Fees and charges specified in the Merchant Agreement apply throughout the Offer Period.
Yocale Pay will not be liable for any direct, indirect, incidental, special or consequential damages arising out of the Offer. By participating in the Offer, you waive your right to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the incident upon which the claim or action is based. A class action will not be permitted in response to any dispute, claim, or other action arising out of or associated with the Offer.
