Privacy Policy

We understand the great responsibility that comes with the fact that you are trusting us with your personal information when you use our services. As such, we work hard to protect your data.

This Privacy Policy is designed to help you understand exactly the types of information we collect, why we collect it and how you can update and/or delete your information.

1. Entities and this Policy

These privacy terms apply to the Yocale Network Corporation website located at www.yocale.com and the services maintained by Yocale Network Corporation. By accessing and using this Website, you shall be deemed to have accepted and agreed to the terms set forth by our “Privacy Policy.” If you do not agree to this Privacy Policy, please do not use this Website.

This Privacy Policy may be changed from time to time. Changes will be posted on this page and your use of this Website after such changes have been posted will constitute your agreement to the modified Privacy Policy and all of the changes.

2. Consent and Information Collection

In some cases, we do collect information with the intent to provide the best service to our users. However, we will always ask for your consent as required by law, whether specific consent or explicit. You also have the right to withdraw consent at any time.

For the purposes of this Privacy Policy, “personal information” means any information about an identifiable individual, as further defined under British Columbia’s Personal Information Protection Act, The General Data Protection Regulation or other applicable laws.

Yocale does not collect Personal information about your name, position name or title, business telephone number, business address, business email or business fax number of an individual. The same applies to any publicly available information as designated under applicable laws, such as information available from a public telephone directory or from a public registry.

When you visit and/or use the Website or communicate with us via email, social media, live chat, or contact forms located on the Website, we may ask for personal information that will be used in accordance with this Privacy Policy.

We also collect your Internet Protocol (“IP”) address, your operating system, the browser type, the address of a referring website, your user preferences and your activity on the Website. We treat this information as personal information if we combine it with or link it to any of the identifying personal information as defined above.

We will store your personal information securely on Microsoft Azure servers which use Advanced Encryption Standard (AES 256) encryption.

If you provide Yocale, or its Businesses or Providers providing service offerings through the Website (individually or collectively) or agents with personal information about an individual, you represent that you have all necessary authority and/or have obtained all necessary consents from such individual to enable Yocale to collect, use, and disclose such personal information for the purposes set forth in this Privacy Policy.

3. Information collected by Yocale Subscribers from end users

Subscribers are business users who use yocale practice management.

Data collected from Yocale end users (consumers) by Yocale Subscribers (business users) are completely under the direction of the Subscribers and Yocale has no direct relationship with data collection of the individuals whose personal data it processes.

If you are an end user of one of Yocale Subscribers would no longer like to be contacted by one of our Subscribers that use our service, the arrangement must be made between the end user and Subscriber directly.

We are not responsible for the privacy or data security practices of our customers, which may differ from those set forth in this Privacy Statement.

Yocale does not choose or determine the categories of Collected Information that relates to the Personal Data. Subscribers solely determine the Personal Data are responsible for use beyond Yocale services.

Yocale may transfer Collected Information to third parties that help us provide our service. Transfers to these third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Subscribers.

If the Subscriber requests Yocale to remove the data, we will respond to their request within 30 business days.

4. Use of Information

We may use your personal information for the following purposes:

  • To provide the features and functionality of the Website, including without limitation, to (i) search and find Businesses and Providers in your local community; and (ii) engage with, schedule appointments with, and rate, review and rank the Business or Provider.

  • To create, manage, and control your account information, and to verify access rights to the Website.

  • To monitor your use of the Website.

  • To provide your personal information to the Business or Provider to whom you consent your personal information to be provided in connection with the services to be provided to you by such Business or Provider.

  • To communicate with you, including without limitation for the purpose of providing you with information about the Website and the features and functionality thereof, or informing you of changes or additions to the Website or of the availability of any other services or features we provide.

  • To enforce this Privacy Policy or our Website Terms of Use.

  • To protect against fraud or error, and to respond to claims of any violation of our rights or those of any third parties.

  • To respond to your requests for customer service.

  • To protect the rights, property, or personal safety of you, us, our users, and the public.

  • For our internal business purposes, such as to analyze trends and statistics, for audits, to develop new programs, to enhance our websites, to improve our programs and services, to identify usage trends, and to determine the effectiveness of our promotional campaigns.

  • To prevent, detect, and investigate activity and transactions that are suspicious, fraudulent, or violate our Website Terms of Use.

  • As required or authorized by law; and

  • Other purposes consented to by you.

You also may provide personal information to be transmitted to other users of the Website or service providers (collectively, “User Contributions”). Your User Contributions are published or displayed on the Website and are transmitted to others at your own risk. We cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

5. Sharing of Personal Information

Yocale may disclose an individual’s personal information to others in connection with the purpose for which it was collected, as consented to by the individual, or as required or permitted by law. We will ask for explicit consent in the event of processing special categories of data and as required by law.

Yocale may share your personal information in the certain situations. Examples of where your personal information may be disclosed include:

  • We may share your personal information when you find Businesses or Providers through the features and functionality of the Website and schedule appointments with the Business or Provider.

  • We may share your personal information with Businesses or Providers or other users of the Website when you access features of the Website that enable you to contact Businesses or Providers or other users with respect to a search for certain services.

  • We may share your personal information with certain hosting providers, printers, vendors, consultants, and credit card or payment processing companies (“Other Service Providers”). When we engage other Businesses or Providers who manage personal information on our behalf and/or perform services on our behalf, such as hosting content, conducting surveys, sending communications, processing payments, or helping prevent fraudulent transactions, we may share your personal information with such other Businesses or Providers under the requirement that such personal information is used only to provide services to us.

Yocale is not responsible for the actions of any independent third parties you may choose to engage with directly, nor are we responsible for any additional information you provide directly to any third parties, and we encourage you to become familiar with their privacy practices before disclosing information directly to any such parties.

Any cross-border transfers of personal information, should it occur, will only be done in accordance with the regulations set forth by the GDPR.

Yocale will not use or access any User (Member, Business or Provider) information unless authorized to do so by the User by this Agreement (including, but not limited to, the Privacy Policy) and, in such circumstances, Yocale will access and use the Users Information only as expressly permitted by this Agreement or required to perform the requested Services. Notwithstanding the foregoing, during the Term, any Additional Term and afterwards, Yocale may use the User Information anonymously or aggregated so that it is no longer personally identifiable for any purpose and Yocale may transfer, convey, sell, manipulate, and otherwise exploit such anonymous or aggregated User Information.

6. Automated Decision Making and Your Rights

Yocale acknowledges your right to information about the circumstances involved in automated decision making and your right to not be involved (unless it is deemed necessary and is permitted by law).

Yocale only tracks logins into the Yocale app when logged in with Intercom. Behaviour is also tracked in Fullstory. Lastly, Yocale takes your information to create an account for both Facebook and Google registration.

7. Rights to Your Information & How to Request the Removal of Personal Data

We strive to ensure that any personal information we retain and use is accurate, complete and up-to-date as necessary for the purposes for which we will use it. If our records regarding your personal information are inaccurate or incomplete, we will amend that information or transfer your information at your request.

Yocale also acknowledges your right to request that your personal data is removed or deleted in the event that there is no need for its continued processing. We also acknowledge your right to object to data processing activities.

In the event that your data is no longer required or if you withdraw consent, we will always erase your personal data without delay. Further, we will always take reasonable steps to communicate the removal of your personal data to others who may also have your data and as required by law.

Finally, we also acknowledge your rights to request a copy of your personal information. As such, Yocale will always respond to your request for a copy of your personal information, which will be provided in a commonly used electronic format.

8. Aggregated Data

We may also use your personal information and Website usage statistics to generate Aggregated Data for internal use and for sharing with others on a selective basis. “Aggregated Data” means records which have been stripped of information potentially identifying customers or users, and which have been manipulated or combined to provide generalized, anonymous information. Your identity and personal information will be kept anonymous in Aggregated Data.

9. Links

The Website may contain links to other websites. This Privacy Policy does not apply to other websites and services and we are not responsible for the privacy practices or the content of such websites and services. We encourage you to read the privacy policy of linked websites and services prior to providing them with personal information. Their privacy policies and practices may differ significantly from our policies and practices.

10. Cookies and Log Files

We may use cookies and log files to track user information. Cookies are small amounts of data that are transferred to your web browser by a web server and are stored on your computer’s or mobile device’s hard drive. We use cookies to track which page variant a visitor has seen, to track if a visitor has clicked on a page variant, to retain info on previous user searches, to monitor traffic patterns and to gauge popularity of website pages and options. We will use this information to deliver relevant content and services to you.

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or functionality of our Website.

11. Change of Ownership or Business Transition

In the event of a change of ownership or other business transition, such as a merger, acquisition or sale of our assets, your information may be transferred in accordance with applicable privacy laws.

12. Security

First and foremost, Yocale takes data governance very seriously. As such, we have implemented numerous accountability measures to both identify and minimize any potential privacy risks.

Accountability measures include those outlined by both the PIPA and the GDPR, such as privacy impact assessments (PIAs), audits, activity reports and so on.

We will strive to prevent unauthorized access to your personal information, however, no data transmission over the Internet, by wireless device or over the air, is guaranteed to be 100% secure. We will continue to enhance security procedures as new technologies and procedures become available. Please remember that you control what personal information you provide while using the Website. Ultimately, you are responsible for maintaining the secrecy of any personal information provided in connection with the use of the Website.

Always be careful and responsible regarding your personal information. We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the personal information you provide to others through the Website.

Similarly, we cannot assume any responsibility for the content of any personal information or other information which you receive from other users through the Website, and you release us from any and all liability in connection with the contents of any personal information or other information which you may receive using the Website. We cannot guarantee, or assume any responsibility for verifying, the accuracy of the personal information or other information provided by any third party. You release us from any and all liability in connection with the use of such personal information or other information of others.

Again, the safety of your data is one of our utmost priority and we take all measures to safeguard your personal information. However, in the event that a data breach does occur, we will notify you without delay and within 72 hours of discovering that such a breach has occurred.

13. Why do we ask you to consent to electronic communications?

Because you are most likely signing up to Yocale to book appointments with a certain provider (doctor, dentist, hair dresser, etc..), and in order for us to confirm your bookings as well as notify you of changes to these bookings, we must send you an email / SMS (depending on your settings).
When you book an appointment on Yocale, the following will take place”

  • We will send you a confirmation email to the email you registered with

  • We will send you a confirmation SMS to the mobile number you specified in your profile (you can turn this on or off at any time)

  • We will schedule one or two reminder emails (depending on the provider’s cancellation policy) to remind you of your appointment (usually 24 hours before cancellation deadline and before appointment date)

  • We will schedule one or two reminder SMS messages (depending on the provider’s cancellation policy) to remind you of your appointments (You can turn SMS on or off at any time)

  • We will send you a post-appointment email (receipt, review) to ask you how the appointment went. In some cases, provider may turn these off so you would not receive these emails.

  • If your provider changes or cancels the appointment for any reason, we will send you an email / SMS notification informing you of this change.

At any point in time, you can choose to unsubscribe from all these emails / SMS messages by clicking on the unsubscribe link at the bottom of any email your receive, or replying “STOP” to any of the SMS messages you receive. Just note however that this will stop all emails and SMS messages from all Yocale providers and you will no longer receive any of the emails or SMS messages listed above.
